CONTRACT FOR SERVICES

THIS AGREEMENT is made and entered into on this [Date] day of [Month], [Year], by and between:

G50 Golf  (hereinafter referred to as “G50 Golf”), a company registered in [State], Australia, with its registered office at [Address], and

[Trainer’s Full Name] (hereinafter referred to as “Trainer”), a PGA-qualified golf professional, with an address at [Trainer’s Address].

WHEREAS, G50 Golf is engaged in the business of providing group golf lessons at various locations in Australia and wishes to engage the services of the Trainer to conduct these lessons in accordance with the guidelines and sessions provided by G50 Golf;

AND WHEREAS, the Trainer agrees to provide such services on the terms and conditions set forth herein;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties agree as follows:

1. Engagement of Services

G50 Golf hereby engages the Trainer, and the Trainer agrees to provide group golf lessons at locations approved by G50 Golf for the purpose of providing G50 session programs, in accordance with the guidelines and sessions provided by G50 Golf.

2. Term

This Agreement shall commence on [Start Date] and shall continue until terminated by either party in accordance with the provisions of this Agreement.

3. Locations

The Trainer shall provide the services at locations that have been approved by G50 Golf for the purpose of providing G50 session programs. G50 Golf reserves the right to change the approved locations and will provide reasonable notice to the Trainer of any such changes.

4. Compensation

4.1 The Trainer shall be entitled to 70% of the total revenue received for each class conducted by the Trainer.

4.2 Payments shall be made to the Trainer within [Number] days of receipt of the total class revenue by G50 Golf.

4.3 G50 Golf will retain 30% of the total revenue received for each class.

5. Scheduling of Classes

5.1 The Trainer is required to log into the G50 Golf website and schedule the classes and the number of classes for the following week at least one week in advance.

5.2 Failure to schedule the classes in the required timeframe may result in the cancellation of the Trainer’s classes for that week and may be considered a breach of this Agreement.

6. Guidelines and Sessions

The Trainer agrees to follow the guidelines and sessions provided by G50 Golf. Any deviation from these guidelines must be approved in writing by G50 Golf.

7. Independence of Trainer

7.1 The Trainer is an independent contractor and is not an employee, partner, or agent of G50 Golf.

7.2 The Trainer shall be responsible for all taxes, superannuation, and other obligations as an independent contractor.

8. Insurance

The Trainer shall maintain professional indemnity and public liability insurance in a minimum amount of AUD [Amount] and shall provide proof of such insurance to G50 Golf upon request.

9. Termination

9.1 Either party may terminate this Agreement with [Number] days’ written notice to the other party.

9.2 G50 Golf may terminate this Agreement immediately if the Trainer fails to comply with the guidelines and sessions provided by G50 Golf, fails to schedule classes in the required timeframe as outlined in clause 5.1, or engages in conduct that could harm the reputation of G50 Golf.

10. Confidentiality

The Trainer agrees to keep confidential any proprietary or confidential information of G50 Golf and shall not disclose such information to any third party without the prior written consent of G50 Golf.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Queensland, Australia.

12. Dispute Resolution

Any disputes arising under this Agreement shall be resolved through negotiation between the parties. If a resolution cannot be reached, the dispute shall be referred to mediation in accordance with the laws of Queensland, Australia.

13. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind.
